Terms of Service

1. About these terms

These Terms of Service ("Terms") apply when you use the Echidna website at evrywhere.dev and the Echidna web app, including when you join the waitlist ("Echidna", "we", "us"). By creating an account or using Echidna, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Echidna.

2. Who can use Echidna

You must be at least 18 years old to create an account. Echidna is built for drivers across Australia.

3. Your account

• You can sign up with an email sign-in link or with your Google account. When you use Google, Google's own terms also apply to that sign-in.
• Please give accurate details and keep access to your email or Google account secure. You're responsible for activity on your Echidna account.
• Tell us straight away at hello@evrywhere.dev if you think someone else has accessed your account.

4. What Echidna does (and doesn't)

Echidna brings public EV charging locations from many networks into one map. It adds features such as saved chargers, your vehicle profile, Confidence Scores and Intent Hold.

Echidna is an early-access product. Features may change, be limited, or be removed as we build. We aim to keep Echidna running smoothly, but it may sometimes be unavailable or contain errors.

Echidna is not a charging network. We don't own, operate or maintain chargers, and we don't control their pricing, availability or condition.

5. Charger information & Confidence Scores

• Charger details come from sources including Transport for NSW open data, charging networks and other drivers. That information can be incomplete, out of date or wrong.
• A Confidence Score is our estimate of how likely a charger is to be working and usable. It's based on the information available to us. It is not a guarantee, and a high score doesn't mean a charger is free or working.
• Before relying on a charger, especially on long trips or with low battery, check the operator's own app or signage. Plan a backup, and check that the connector suits your vehicle.
• Never use Echidna in a way that distracts you while driving. Always obey road rules and parking signs.

6. Intent Hold

Intent Hold lets you signal that you're heading to a charger, and it may alert you about changes in likely availability. An Intent Hold is not a booking or reservation. It doesn't hold a bay for you or stop anyone else from using the charger. Holds expire automatically.

7. Things you contribute

You may share information such as charger reports, status updates, notes and feedback ("Contributions"). You keep ownership of your Contributions.

You grant us a non-exclusive, royalty-free, worldwide licence to use, store, adapt and display your Contributions to operate and improve Echidna and to help other drivers. Where we show Contributions to others, we show them without your name.

Please only share information you believe is accurate. We may remove Contributions that are false, misleading or break these Terms.

8. Acceptable use

You agree not to:

• submit false or misleading charger reports, or place Intent Holds you don't intend to use
• scrape, copy, bulk-download or resell Echidna's data or Confidence Scores, or use automated tools to access Echidna without our written permission
• try to access other people's accounts or data, probe or break our security, or disrupt the service
• reverse engineer Echidna, except where the law allows it
• use Echidna for anything unlawful, harmful or abusive

9. Third-party networks & services

Echidna links to and relies on services we don't control. These include charging networks, map providers, Google sign-in and hosting providers. Your use of a charger or another provider's service is governed by that provider's terms and pricing. We aren't responsible for third-party services, but we'll help where we reasonably can.

10. Fees

Echidna is currently free. If we introduce paid features, such as bookings or payments, we'll show the price and any extra terms clearly before you pay. You won't be charged for anything you haven't agreed to.

11. Our intellectual property

We own, or are licensed to use, Echidna's software, design, branding, Confidence Score methodology and compiled datasets. We give you a personal, non-transferable, revocable right to use Echidna for your own non-commercial purposes under these Terms. Third-party data is used under its own licence, including Transport for NSW data under CC-BY 4.0.

12. Australian Consumer Law & liability

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law, or any guarantee that can't lawfully be excluded.

Subject to that, and to the extent the law allows:

• Echidna is provided "as is". We don't promise that charger information or Confidence Scores will be accurate, complete or current.
• We aren't liable for indirect or consequential loss. This includes time lost, travel costs, being unable to charge, or towing or roadside assistance costs arising from relying on Echidna.
• Where our liability for a failure to meet a consumer guarantee can be limited, we limit it to supplying the service again or paying the cost of having it supplied again.

13. Suspension & closing your account

You can stop using Echidna at any time. To delete your account and data, email hello@evrywhere.dev.

We may suspend or close an account that seriously or repeatedly breaks these Terms, or where needed to protect other users or Echidna. Where reasonable, we'll tell you first.

14. Changes to Echidna or these Terms

We may update these Terms as Echidna grows. We'll change the effective date above. If a change materially affects you, we'll notify you by email or in the app before it takes effect. If you keep using Echidna after that, the updated Terms apply.

15. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of its courts.
